Pool Installation and Maintenance Services

1. Acceptance of Terms

By accessing and using our pool installation and maintenance services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you and our company. If you do not agree with any part of these terms, you must discontinue use of our services immediately.

These terms apply to all visitors, users, and others who access or use our services, including but not limited to pool installation, maintenance, repair, and consultation services.

2. User Obligations and Responsibilities

2.1 General Obligations

As a user of our services, you agree to:

  • Provide accurate and complete information regarding your pool installation or maintenance requirements
  • Ensure safe and unobstructed access to the work area for our technicians
  • Comply with all local building codes, regulations, and permit requirements
  • Maintain appropriate insurance coverage for your property
  • Promptly notify us of any changes to project specifications or site conditions

2.2 Safety and Compliance

You are responsible for ensuring that all safety protocols are followed during service delivery. This includes keeping children and pets away from work areas, ensuring proper lighting and ventilation, and maintaining clear emergency access routes.

Important: Failure to comply with safety requirements may result in service suspension and additional charges.

3. Service Limitations and Scope

3.1 Service Boundaries

Our services are limited to pool installation, maintenance, and repair activities as specifically outlined in your service agreement. We do not provide:

  • Electrical work beyond pool-specific equipment installation
  • Major landscaping or hardscaping modifications
  • Structural modifications to existing buildings
  • Permit acquisition services (client responsibility)
  • Insurance claims processing or documentation

3.2 Environmental Limitations

Service delivery may be affected by weather conditions, soil conditions, or other environmental factors beyond our control. We reserve the right to postpone or modify services when safety or quality standards cannot be maintained.

4. Intellectual Property Rights

All intellectual property rights in our service methodologies, designs, documentation, and proprietary techniques remain our exclusive property. This includes but is not limited to:

  • Custom pool designs and engineering specifications
  • Installation procedures and technical documentation
  • Maintenance protocols and schedules
  • Training materials and operational guides
  • Software applications and digital tools

You are granted a limited, non-exclusive license to use any provided documentation solely for the purpose of maintaining your pool system. Reproduction, distribution, or commercial use of our intellectual property is strictly prohibited.

5. Liability Limitations and Disclaimers

5.1 Limitation of Liability

Our liability for any claims arising from our services is limited to the total amount paid for the specific service giving rise to the claim. We shall not be liable for:

  • Consequential, indirect, or punitive damages
  • Loss of use, revenue, or anticipated profits
  • Damage to property not directly related to our services
  • Delays caused by circumstances beyond our reasonable control

5.2 Force Majeure

We are not liable for delays or failures in performance resulting from acts of God, natural disasters, government actions, labor disputes, material shortages, or other circumstances beyond our reasonable control.

5.3 Warranty Limitations

All services are provided "as is" with warranties limited to those expressly stated in your service agreement. We disclaim all other warranties, whether express or implied, including warranties of merchantability and fitness for a particular purpose.

6. Payment Terms and Conditions

Payment terms are specified in individual service agreements. Generally, payment is due according to the agreed schedule, with final payment due upon completion of services. Late payments may incur additional charges and may result in service suspension.

You are responsible for all costs associated with collection of overdue accounts, including reasonable attorney fees and court costs.

7. Dispute Resolution

7.1 Mediation

Any disputes arising from these terms or our services must first be addressed through good faith negotiation. If direct negotiation fails, disputes shall be resolved through binding mediation conducted by a qualified mediator.

7.2 Arbitration

If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with applicable arbitration rules. The arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.

7.3 Governing Law

These terms are governed by local laws and regulations. Any legal proceedings must be conducted in the appropriate local jurisdiction.

8. Termination and Cancellation

Either party may terminate services with appropriate notice as specified in the service agreement. Cancellation fees may apply for services cancelled after commencement. Upon termination, all outstanding payments become immediately due.

9. Privacy and Data Protection

We collect and process personal information necessary for service delivery. Your information is protected according to applicable privacy laws and is not shared with third parties except as necessary for service completion or as required by law.

10. Modifications and Updates

We reserve the right to modify these terms at any time. Updated terms will be effective immediately upon posting. Continued use of our services after modifications constitutes acceptance of the updated terms.

Effective Date: These Terms and Conditions are effective as of the date of your first use of our services and remain in effect until terminated or modified.
